3. Estimates and Pricing

All prices and estimates are subject to on-site review and confirmation. Written estimates provided by Eastern Goleta Valley Asphalt Paving are valid for the period stated in the estimate document. No estimate is binding until both parties have signed a written agreement.

Estimates may change if unforeseen site conditions are discovered during the work - for example, damage to a base layer that was not visible during the initial assessment. We will communicate any such changes before proceeding with additional work. Final pricing reflects the actual scope completed.

4. Scheduling and Cancellation

Scheduled work dates are subject to availability and weather conditions. Asphalt paving and sealcoating cannot be performed in rain or on saturated surfaces. If weather requires rescheduling, we will notify you as soon as possible and arrange an alternate date.

If you need to cancel or reschedule a confirmed appointment, please notify us at least 48 hours in advance. Late cancellations may result in a scheduling or mobilization fee as stated in your written agreement.

We reserve the right to decline or discontinue work on a project if site conditions are unsafe or if the conditions differ materially from what was assessed during the estimate.

5. Payment Terms

Payment terms are set out in the written agreement for each project. A deposit may be required prior to scheduling. The remaining balance is typically due upon completion of the work unless otherwise stated in writing.

Invoices not paid by the due date may be subject to a late fee as specified in the agreement. Eastern Goleta Valley Asphalt Paving reserves the right to suspend or refuse future services for accounts with outstanding balances.

6. Warranty and Workmanship

Any warranty provided on workmanship will be stated in the written project agreement. Warranties cover defects in workmanship under normal use and do not cover damage caused by improper use, third-party alterations, tree root intrusion, ground movement, flooding, or other conditions outside our control.

To maintain any warranty, the customer must follow any care and maintenance guidelines provided at project completion, including restrictions on early use of newly paved surfaces.

9. Customer Responsibilities

You agree to provide accurate information when requesting an estimate or scheduling work. You are responsible for ensuring that the work area is accessible on the scheduled date - including removing vehicles, equipment, and personal property.

If you are in a community with a homeowners association, you are responsible for obtaining any required HOA approvals before work begins. Delays or costs resulting from missing approvals are the responsibility of the customer.

10. Permits and Code Compliance

Where a project requires a permit or approval from a local authority, responsibility for obtaining that permit will be addressed in the written project agreement. Customers are responsible for ensuring their property is not subject to deed restrictions, easements, or other encumbrances that would affect the work. Eastern Goleta Valley Asphalt Paving is not liable for delays or costs arising from permit requirements that were not disclosed prior to the estimate.

11. Dispute Resolution

If a dispute arises relating to these terms or any project, both parties agree to first attempt to resolve the matter in good faith through direct communication. If informal resolution is not successful within 30 days, the parties agree to participate in non-binding mediation before pursuing formal legal action.

Nothing in this section limits either party from seeking emergency injunctive or other equitable relief from a court where necessary to prevent imminent harm.

12. Governing Law

These terms and conditions are governed by the laws of the State of California, without regard to its conflict of law principles. Any legal action arising from these terms or from services provided by Eastern Goleta Valley Asphalt Paving will be brought in a court of competent jurisdiction in California.
